These Terms are an agreement between you and Arsen Marianovych Polivka, a sole proprietor (FOP) registered in Ukraine, e-mail: support@quizyk.com ("we"), which operates the Quizyk service (the https://quizyk.com website and app, the "Service"). You accept these Terms by ticking the checkbox when you sign up. If you take a test as a guest, the Terms apply to that use.
How we process personal data is described in the Privacy Policy: /privacy/.
01The Service
Quizyk lets you create tests and surveys, share them, take them with an account or as a guest, run live rooms, work in workspaces and classes, and earn certificates. The Service is currently free of charge. If we introduce paid features, their terms and prices will be published separately before you can pay for them, and free use will not become paid without your express agreement.
Some features are marked as beta (for example AI question generation). They may change or be less stable.
02Your account
- You can sign up on your own from the age of 16. Younger users only with the consent of a parent or other legal guardian, or through a school or teacher responsible for that consent.
- Give accurate details and keep them up to date. One account per person.
- Keep your password and e-mail access secure. Tell us if you suspect unauthorised access.
- You can stop using the Service and ask us to delete your account at any time — see "Termination".
03Your content
Tests, questions, images and other material you create ("Content") remain yours. So that the Service can work, you grant us a non-exclusive, royalty-free, worldwide licence to store, reproduce, adapt for display on different devices and show your Content — within the access settings you choose, and only to provide and improve the Service. For published tests this also covers showing them in the catalogue, search results, link previews and on your profile page.
By publishing a test (making it public) you also allow other users to take it and to make a copy of it in their own account for educational use, including modifying that copy. Private tests and tests with an access code are available only to people you give the link or code to, and cannot be copied from the catalogue.
The licence ends when you delete the Content or your account, except for copies other users have already made of a published test, results participants have already received, and residual backups until they are overwritten.
You confirm that you hold the rights to the Content you upload and that it does not infringe anyone else’s rights, including copyright in textbooks, tests or images.
04If you collect participants’ responses
The author of a test, or the owner of a class or workspace, decides what participant data to collect (including through intake fields) and is the controller of that data. You agree to have a legal basis for it, to inform participants, to collect no more than you need, and not to collect special categories of data (health, religious beliefs and similar) or ID numbers. We process such data only to provide the Service to you.
05Prohibited use
You must not use the Service to:
- post illegal content, including content that infringes intellectual property, incites violence or discrimination, promotes war or an aggressor state, or sexually exploits children;
- harass, threaten or abuse others, or disclose other people’s personal data;
- send spam, phishing or malicious code;
- circumvent the Service’s protections, obtain correct answers outside a test’s rules, interfere with our servers, or scrape data without our permission;
- impersonate another person or organisation.
06AI features
During AI import the text, PDF or video transcript you submit is sent to our provider (Anthropic) to generate questions. Generated questions can contain mistakes: review them before use. Do not submit material you have no rights to, or that contains other people’s personal data.
07Reporting content and moderation
You can report illegal content or a breach of these Terms with the "Report" button on a test page or by e-mail to support@quizyk.com. Include the link, the reason and, if you wish, your contact details. We handle every notice in a timely, diligent and objective way; decisions are made by people on our team. This address is also our single point of contact for authorities and users.
If content breaks the law or these Terms, we may unpublish or remove the test, or restrict or suspend the account, in proportion to the breach. We will tell the author about the decision and the reasons for it, unless the law forbids it. You can appeal within 6 months by replying to the notice or writing to us; the appeal is reviewed by a different person from the one who decided. This does not affect your right to go to court.
We are not obliged to pre-screen all content, but we act once we become aware of a breach.
08Our intellectual property
The Quizyk name, logo, design and software belong to us. These Terms give you no rights in them beyond using the Service as intended.
09Availability and changes to the Service
We aim to keep the Service running without interruption, but maintenance breaks and outages can happen. We may change features. We will give at least 30 days’ notice before discontinuing a significant feature or the whole Service and, on request, provide your data in a machine-readable format.
10Termination
You can stop using the Service at any time and ask for your account to be deleted from Settings or by e-mail to support@quizyk.com.
We may suspend or close an account for a serious or repeated breach of these Terms or of the law. We will tell you in advance and give reasons, except where we must act immediately to protect other users, the Service or to comply with the law. You can appeal as described under "Reporting content and moderation".
11Liability
The Service is provided free of charge. We are liable for damage caused intentionally or through gross negligence, for harm to life and health, and wherever liability cannot be limited by law. Otherwise we are liable only for foreseeable damage that typically results from our breach of an essential obligation under this agreement.
We are not responsible for content created by other users, or for how test authors use results. Nothing in these Terms limits your consumer rights under the Law of Ukraine "On Consumer Rights Protection" or the mandatory law of your country of residence.
12Governing law and disputes
These Terms are governed by the law of Ukraine. If you are a consumer living in the EU/EEA, you keep the protection of the mandatory law of your country of residence.
Please write to us first at support@quizyk.com — most issues can be solved that way. Otherwise a dispute is heard by a court under the procedural law of Ukraine; a consumer may also bring proceedings in the courts of their place of residence. These Terms contain no arbitration clause and do not limit your right to join a collective action.
13Changes to these Terms
We may change these Terms for valid reasons — changes in the law, in the Service, or to protect users. We will announce material changes at least 30 days in advance in the app or by e-mail, and a new version applies to you only once you accept it. If you do not agree, you can stop using the Service and delete your account.
14Miscellaneous
If any provision of these Terms is found invalid, the rest remains in force. The Terms are issued in Ukrainian and English; if the two differ, the Ukrainian version prevails.
